Terms and Conditions of Rental and Liability Waiver

 

This contract constitutes an agreement between the Guest(s) and Hocking Hills Cabins and Resorts (HHCR) and/or its Agent(s). The restrictions, conditions and limitations described below are included as part of this agreement.

 

  1. The Guest(s) understands that the accommodations are privately owned, furnished by the owner and are as advertised on a network of websites. HHCR or Agents are not required or obligated to provide additional furnishings or equipment. Please be sure to leave the cabin as you found them.

 

  1. Check In & Check Out

Check In: is at 4pm. Please see access instructions under directions. Early check in may be possible with an additional fee, contact the office to discuss options and APPROVAL. Our check in time is 4:00PM. Early arrival will result in unnecessary waiting time OUTSIDE of the property. Due to the logistics and complexity of our units, our housekeepers need all the time allotted to them between 11:00AM-4:00PM to clean the properties.

Check Out: is at 11am. Please leave the property in the condition you find it. A violation of the checkout time will result in an automatic late check out fee, charged to the card/account on file, no exceptions.

 

Check Out Expectations:

– Remember to take all food and personal items upon departing the cabin.
– Clean all dirty dishes, pots, pans, and utensils. Empty the coffee pot and rinse out.

– Check under the beds and in drawers/cabinets/closets for personal items and trash and miscellaneous debris in the trash cans. Check outlets for chargers. Place all trash and miscellaneous debris in the trash cans and remove per below.

– Empty all trash cans and take the trash to the dumpster by the large open pole barn along the driveway.

– Leave all towels in a pile in the bathrooms.

– Remove all used bedding and leave in room beside the bed.

– Close and lock doors/windows and turn off lights/electronics.

– Set the thermostat to 69 degrees for heat and 75 degrees for A/C.

– Please lock the door upon departure.

3. General Notes: You may see our team on-site checking/adjusting hot tubs or completing general ground work and housekeeping tasks on a continuous basis. We appreciate your cooperation as we continue to improve the property.

 

  1. Cancellation Policy: No penalty for reservations cancelled 31 days prior to the reservation. Reservations cancelled within 30 -15 days prior to the reservation date are subject to a $100 fee. Any reservation cancelled within 14-7 days prior to the reservation forfeits the 50% deposit. Any reservation cancelled with less than 6 days forfeits the entire reservation. No shows are subject to entire rental fees. Cancellation policy applies to ALL reservations including last minute bookings. No refunds for early departure. No cancellations or refunds due to inclement weather, acts of God, or for mechanical failures out of our control. No refunds will be issued for disruptions of any utilities including but not limited to: power outages, water outages, internet/cable/satellite outages etc. These failures are beyond our control and no refund or rent reduction will be given. SORRY, NO EXCEPTIONS.

 

  1. Age Requirement: Renters must be at least 25 years or older to rent the Fox Fire, Hill of a View, Hemlock Haven or Glass House cabins. Renters must be at least 21 to rent all other cabins. Management may approve additional reservations with a security deposit; however, guests must contact Management for approval and deposit payment. Reservations are not allowed on behalf of a third party unless prior approval is given. Renter must be present at the cabin for reserved dates. A state recognized photo id and valid credit card belonging to the guest named on the reservation are required to book a reservation. HHCR reserves the right to terminate a reservation if requirements are not met.

 

  1. Many properties have special amenities on the property or access to special amenities including, but not limited to: decks, spas, hot tubs, saunas, pond, swimming pools and Jacuzzis. Unless otherwise posted, Guest is allowed reasonable use of these amenities during Guest’s rental period. The Guest recognizes that there are inherent risks in the use of these amenities which may include personal injury and property damage. Guest agrees to use the amenities in a safe manner and follow any instructions regarding the use of the amenity. Guest recognizes that there are risks to children in the use of many of the amenities provided with the property. Guest recognizes that there are risks to the use of any of the amenities provided if they are used in a manner for which they were not designed. The Guest further recognizes that the use of these amenities may be UNSAFE if: used for an extended period of time; used by individuals who are pregnant; used by individuals while under the influence of drugs, alcohol or medication, or; used by individuals with certain health risks. The Guest acknowledges and assumes all risks for the use of any amenity provided with the rental property and the Guest further agrees that the Guest is wholly responsible and liable for any injury or damage to persons or property as a result of their use of the amenities provided with the property. Guest further agrees to indemnify, save, protect, defend and hold harmless HHCR and its Agent of the property for any damages, costs or attorney’s fees incurred as a result of any injury or damage form the use of the amenities. The Guest agrees to assume sole responsibility in relation to these risks and Guest agrees Guest is responsible and liable and will pay agent upon request for any damages to these amenities caused by Guest’s misuse or negligence.

 

  1. Guest agrees to indemnify, save, protect, defend and hold harmless HHCR, its agents or assignees, and the owners of the property for any and all claims, actions, suits, demands, damages and costs relate to defending the same, including attorney’s fees incurred as a result of any injuries to person or damages to property, including any damages that are the result of negligence of HHCR and its agents or assignees; any damages that are the result of HHCR and its agents or assignees, and the owners of the property being sued for as a result of the acts or omissions of Guest or arising out of the acts or omissions of Guest.

 

  1. The Guest understands that each unit is self-catering, which is defined as having a start- up supply of soap, toilet paper and trash bags and the Guest is responsible for their needs after that. Kitchens are equipped with basic cooking items (dishes, silverware, pots, pans, coffee makers, microwaves). HHCR offers no extra towels or maid service during your reservation period. Guests must dispose of trash/debris in dumpster provided on-site.

 

  1. HHCR and its staff or agents reserve the right to enter the rented properties at any time with proper notice provided, with or without Guest’s consent, to inspect property or perform routine maintenance as needed. Our team checks and treats hot tubs daily.

 

  1. All of our properties have Occupancy Limits as stated and on your reservation. These limits include adults and children and if you have more than the allowed occupancy limits staying in the rental property you may be asked to LEAVE without a refund. No additional day or nighttime guests are permitted unless otherwise approved prior to check in with any additional fees remitted.

 

  1. Our properties may have a private area or closet with supplies. If you attempt to break into the areas or any other areas marked as Private you will be charged for breaking and entering private property.

 

  1. PETS are not permitted within the cabins OR on our property. If pets are found occupying the property without authorization, Guest may be asked to leave without a refund and/or charged an automatic $350.00 pet cleaning fee. A minimum of a $350.00 pet cleaning fee will be charged to the card on file if evidence of a pet is found in the cabin (hair, waste, toys, damages, etc). Pet waste removal and pet damages will also be charged accordingly to the card on file upon Guest departure.

 

  1. Each property is inspected by our agents prior to your check in and upon your check out and an inventory is taken. Any missing items, broken items, smoking, unauthorized pets, excessive cleaning, soiled/stained/missing linens, or trash removal will be billed to the credit card on file. In addition, HHCR will charge your credit card for the following items: $75.00 minimum charge for lock outs and $25.00 for lost key replacement, IF APPLICABLE. If the property is left in an unacceptable condition your departure photographs will be taken and a minimum of $100.00 will be charged as an excessive cleaning charge. Hot tubs are inspected and cleaned after guest departure. If any items such as food, alcohol, soaps, bath products, etc. are found in the hot tub or if excessive cleaning is required for the hot tub that leads to having to drain, refill and add chemicals to the hot tub (at our discretion) there will be a charge of $145.00. A $350.00 minimum fee is charged if any evidence of smoking inside the property is noted. Any damaged or missing property and landscaping will be charged at the actual cost of replacement or repair.

 

  1. All of our cabins are NON-SMOKING. This includes e-cigarettes, marijuana, vaping, etc. A $350.00 minimum fee is charged if any evidence of smoking inside the property is noted.

 

  1. The Guest must observe any no trespassing signs for any adjacent properties and must not obstruct access to adjacent properties. Abusive or illegal behavior is not tolerated and you will be asked to leave without a refund if you choose to ignore local rules and regulations. Guests are asked to be respectful of neighboring cabins on the property.

 

  1. No ATV’s, fireworks, shooting or hunting is permitted on the property.

 

  1. Wireless/Wired Internet Access: The wifi service, where available, is provided on an “as is” and “as available” basis, without warranties of any kind. HHCR does not warrant that the services will be uninterrupted, error free or free of viruses or other harmful components. We are not responsible for service disruptions or service failure through the provider. HHCR makes no express warranties and customer waive all implied warranties including, but not limited to, warranties of title, non-infringement, merchantability, and fitness for a particular purpose regarding any merchandise, information or service provided throughout the provided connection or the internet generally. Guest expressly acknowledges that there are and assumes all responsibility related to the security, privacy and confidentiality risks inherent in wireless communications and technology and HHCR does not make any assurances or warranties relating to such risks. No advice or information given by HHCR or its agents shall create a warranty.

WAIVER, RELEASE, AND INDEMNITY AGREEMENT

By completing this reservation, I have read and agree with every statement I make in this document. I understand and agree that I am receiving good, valuable and sufficient consideration for the promises I make in this agreement.

 

  1. Amenity Repairs: Occasionally appliances such as the hot tub, stove, television, and HVAC malfunction. We will service and restore use as quickly as possible but will not make concessions for things outside of our control. Please notify us promptly of any problems so we can have the item serviced as soon as possible.

 

  1. All guests are welcome to:

– Hike and explore the 95 on-site acres

– Fish at the pond (catch and release)

– Swim/use beach area (AT OWN RISK)

– Play sand volleyball (balls are in the bin near the court)

– Use the playground near the volleyball court

We ask that all guests be respectful of other guests/cabins on the property and to please make sure trash/debris are properly picked up and disposed of while visiting.

 

  1. Fishing/Swimming Pond: The pond is stocked and guests can use at your own risk, there is no lifeguard on duty.

 

  1. What to bring: Our cabins are self-catering units. We supply bed linens, bath towels, washcloths, pillows, pots, pans, silverware and basic cooking utensils. You will need to supply your own toilet paper, paper towels, trash bags and dishwasher tabs (if your cabin has one), once the starter supply has been used or if you have a specific brand you “only” use bring it with you. We recommend guests bring beach towels for the hot tub. Bring your own food and food related items including coffee, coffee filters/kcups, seasonings, foil, bags, etc. The cabin uses well water (with water softeners) – bring water bottles, jugs and ice if desired. Bring your own clothes, personal toiletries, electronics, chargers, fire starting materials and wood for fire-pits, and small kitchen appliances (crockpots/juicers/blenders). Feel free to bring games, movies and electronics. If you have something you cannot “live” without – bring it with you. Bring camper chairs to enjoy time by the firepit.

 

  1. Bugs/Wildlife: Please be aware that you are coming to stay in the middle of the woods and there are tons of bugs/wildlife in the area. While we have our cabin treated on a regular basis, it is likely you will see bugs/wildlife during your stay. We do not offer rental concessions if you see any during your stay.

 

  1. Guests must complete a precheck-in prior to arrival that requires ID verification and review/sign agreement of terms and conditions to receive access information.

 

 

HOT TUB SAFETY RULES AND GUIDELINES

  1. You use the Hot Tub at your OWN risk. We cannot be held responsible for your safety while you are using the Hot Tub.
  2. Before entering Hot Tub, check the water temperature. If the temperature exceeds 104* F do not enter and contact management and housekeeping immediately.
  3. Do not enter the Hot Tub if it is cloudy. Contact management immediately.
  4. Make sure to shower with soap before entering the Hot Tub.
  5. Enter and exit the Hot Tub slowly.
  6. No diving or jumping in the Hot Tub.
  7. Elderly persons and pregnant women should consult a physician before using a Hot Tub.
  8. No glass should be brought into or near the Hot Tub.
  9. All children must be supervised by an adult.
  10. Anyone with diabetes, heart disease, high or low blood pressure or any serious illness should consult a physician before entering the Hot Tub.
  11. People with external infections, wounds or cuts should avoid the Hot Tub until they are fully healed because the hot water can carry and pass on the infection to others and or cause a new infection.
  12. Do not add soaps, oils, sunscreens, makeup, detergents or any form of liquids to the Hot Tub.
  13. Do not introduce mud, stones, sticks, grit etc. into the water.
  14. Eating food, drinking and smoking is prohibited while in the Hot Tub. Hot water amplifies the effects of alcohol and certain drugs and the result can be dangerous.
  15. Never handle a corded electrical device while you are in the Hot Tub.
  16. Please do not sit or lay on the Hot Tub cover.
  17. All jets must be turned off after use.
  18. Limit your soak time in the Hot Tub to 15 minutes and allow your body to cool off before re-entry.
  19. You will be held responsible for any damage and any cost involved will be taken from your security deposit or credit/ debit card.
  20. If the Hot Tub becomes unusable during your stay due to your negligence, a charge of $145 will be levied against your security deposit if you wish to continue to use the hot tub. This will cover the cost of emptying, cleaning, recharging it with water and chemicals and reheating it.
  21. We do not adjust/refund your account for mistreatment of the hot tub.
